Do you specialise in this area of law, and how many similar matters have you handled in the last year?

A lawyer who handles everything. Property, criminal, family, contracts. Is rarely the best choice for a specific matter. Ask about their proportion of work in your area of law and how many active matters of the same type they currently have.

What court will this matter be heard in, and do you regularly practice there?

Court-specific familiarity matters: procedural preferences, typical timelines, and judicial inclinations vary by court and even by bench. An advocate who appears regularly in the relevant court has a practical advantage.

What is your honest assessment of the strength of my case?

This question tests honesty. A good lawyer will identify both the strengths and the weaknesses of your case based on facts and applicable law. Anyone who tells you unequivocally that you will win, without caveats, is not giving you sound legal advice.

What is a realistic outcome. Not an optimistic one?

Ask what the range of realistic outcomes is: best case, most likely, and worst case. For disputes, ask what percentage of similar cases the lawyer has seen resolved in each direction. This framing helps you make an informed decision about whether to proceed.

What is a realistic timeline?

Get an honest timeline estimate for your specific court, not a national average. Indian court timelines vary enormously. A district court matter can take 2 years or 15 years depending on the jurisdiction and nature of the matter. The lawyer should know the typical timeline for the specific court.

How do you charge. Fixed fee, per-hearing, or retainer?

Get the fee structure in writing. For contentious matters, confirm whether the quoted fee covers only certain stages or the full matter to final resolution. Ask specifically about the cost of ancillary applications (interim orders, amendments, appeals) that may arise.

Will you personally handle the matter or will associates appear?

Associate appearances on routine hearing dates are standard practice. Confirm at which stages you expect the retained advocate to appear personally. Arguments, final hearing, and major applications. And that this is reflected in the fee.

What documentation and evidence should I start gathering now?

A lawyer who gives you a specific list immediately has thought about your case carefully. A vague answer ('just bring everything you have') is less reassuring.

Are there any time-sensitive steps that need to happen before we file?

Limitation periods can be critical. Certain claims must be filed within specific timeframes or they are extinguished. Ask specifically whether any clock is ticking on your matter.

Is there a realistic alternative to litigation for my situation?

Mediation, arbitration, or a negotiated settlement often produces better outcomes faster and at lower cost than full litigation. Ask whether your matter is a candidate for alternative dispute resolution and whether the lawyer would support that approach.

How will you communicate with me. And how often can I expect updates?

Lack of communication is the most common complaint clients have about lawyers. Agree upfront on communication frequency (after each hearing, at minimum), channel (WhatsApp, email, phone), and turnaround time for routine queries.
